Terms of Use
Cohavia is a scheduling and collaboration tool. It is not a law firm, does not provide legal advice, does not determine parenting rights and is not an emergency or family-violence response service.
1. Agreement and operator
These Terms govern access to Cohavia. “Cohavia”, “we”, “us” and “our” mean the person or entity identified as the supplier in your invitation, subscription or order. By selecting “I agree”, creating an account or using the service, you agree to these Terms. If you use Cohavia for an organisation, you confirm that you are authorised to bind that organisation.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering this agreement. You must provide accurate account information, protect your credentials, use multi-factor authentication where offered and promptly tell us about suspected unauthorised access. Accounts are personal and must not be shared.
3. What Cohavia does
Cohavia helps authorised participants record availability, organise scheduling constraints, compare options, make change requests and record proposal decisions. Features may be changed or withdrawn as the service develops. A schedule, suggestion, classification, alert, audit entry or other output is operational information only.
4. No legal advice or legal effect
Cohavia does not provide legal, financial, psychological, counselling or safety advice. It does not replace independent professional advice. A Cohavia proposal, approval or operational schedule does not amend a court order, parenting plan, undertaking or other legal arrangement unless the change is validly formalised outside Cohavia. Lawyers and other professionals remain responsible for their own advice, judgement and professional obligations.
5. Emergencies and safety
Do not use Cohavia to report or manage an emergency, imminent risk, family violence or a child-safety concern. Contact emergency services on 000 or an appropriate professional service. A platform escalation does not guarantee immediate professional review and does not automatically change an existing arrangement.
6. Your information and responsibilities
You are responsible for information you submit and must ensure that it is accurate, relevant and lawful. You must have authority to provide information about another person. Do not upload privileged legal material, court documents, evidence, medical records, protected addresses or other sensitive material unless the relevant feature expressly permits it and appropriate authority has been obtained.
Where Cohavia is used through a law firm or other organisation, that organisation remains responsible for its client relationship, legal file, collection notices, permissions and professional duties. Cohavia is not the authoritative legal file unless expressly agreed in writing.
7. Acceptable use
You must not use Cohavia to harass, threaten, coerce, surveil or mislead another person; breach an order or law; impersonate someone; obtain unauthorised access; introduce malicious code; interfere with security; scrape the service; or use information for a purpose unrelated to the relevant matter. We may restrict or suspend access where reasonably necessary to protect a person, the service or other users.
8. Access and sharing
Access is role- and matter-specific. An invitation, payment or organisational relationship does not automatically grant access to a matter. Users who manage a matter must keep roles current and promptly revoke access that is no longer required. Information made shared within a matter may be visible to the participants shown by the service.
9. Privacy, security and retention
We handle personal information in accordance with applicable privacy law and our published privacy notices. We use reasonable technical and organisational safeguards, but no online service can guarantee absolute security or uninterrupted availability. You must promptly report suspected misuse or a security incident to the contact below.
We may retain account, transaction, audit and matter information for the period reasonably required to provide the service, meet legal obligations, resolve disputes and maintain security. Information that is no longer required will be deleted or de-identified where required by law and subject to any lawful retention requirement.
10. Availability and third-party services
Cohavia may depend on Microsoft Azure, identity, payment, communications and other service providers. We do not promise that the service will always be available, error-free or suitable for every matter. Planned maintenance, security events or third-party failures may affect access.
11. Fees and cancellation
Fees, billing periods, included features, renewal terms and any cancellation or refund rights will be disclosed before purchase. Unless otherwise stated, fees are in Australian dollars and include GST where applicable. Payment never changes a participant’s visibility, approval authority or matter permissions.
12. Intellectual property
We retain rights in the Cohavia service, software, design and documentation. You retain ownership of information you provide. You grant us a limited licence to host, process, reproduce and transmit that information only as reasonably required to operate, secure and improve the service and meet legal obligations.
13. Consumer guarantees
Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law. Any exclusion or limitation in these Terms operates only to the extent permitted by law.
14. Liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of opportunity, loss of profit or loss arising from information supplied by another user. Where our liability may lawfully be limited, our aggregate liability arising from the service is limited to the fees paid for the affected service during the 12 months before the event giving rise to the claim.
This limitation does not apply to liability that cannot lawfully be limited, or to fraud, wilful misconduct, or death or personal injury caused by negligence. The limitation will be read down rather than applied in a manner that would make it an unfair contract term.
15. Suspension and termination
You may stop using Cohavia at any time, subject to any subscription terms. We may suspend or terminate access for material breach, unlawful or harmful use, security risk or non-payment, after reasonable notice where practicable. We will provide a reasonable opportunity to export accessible information unless doing so would create a security, safety or legal risk.
16. Changes to these Terms
We may update these Terms to reflect changes to the service or law. We will give reasonable notice of material changes and request renewed acceptance where appropriate. Changes will not operate retrospectively to remove accrued rights.
17. Complaints and disputes
Please contact us first so we can try to resolve a concern. Nothing prevents a person from contacting a regulator, obtaining legal advice or exercising a statutory right. These Terms are governed by the laws of South Australia, and the parties submit to courts with jurisdiction there.
18. Contact
Questions, complaints and security reports may be sent to mark@fnesg.com. A dedicated Cohavia privacy and support address should replace this contact before public launch.
